Diageo Prize Draw Terms and Conditions

  1. The Promotion is open to all residents of Great Britain aged 18 or over.

  2. Employees of the Promoter and its affiliate companies, their families and anyone deemed to be professionally involved with or connected to the Promotion are not permitted to enter the Promotion.

  3. The Promotion is free to enter and no purchase necessary.

  4. To enter the Promotion, you must follow DUSK on Instagram (@dusk.app), like the post, and tag three friends in the comments of the prize draw post OR follow DUSK on Instagram (@dusk.app) and tag @dusk.app in a picture of your Pimm’s Sundowner Spritz on Instagram between 18:00 Monday 8th August until 9:00am 5th September 2022. Entries received outside of this time will be void and will not be entered into the Promotion.

  5. There will be 1 (one) Prize to be won via a Prize Draw. The Prize is return train tickets to Rye Train Station from a destination of your choice and a two night stay for four people in two rooms at The Gallivant Hotel. The prize includes breakfast, dinner, and a Pimm’s Sundowner activity on the dunes.

  6. Entrants are asked to refrain from sharing these promotional entry details with anyone under the legal purchasing age of 18 years old.

  7. The winner and their companions must be over 18 in order to claim the prize. The winner and their guests must be available to stay at the hotel on the date specified by the Promoter and will be required to provide photographic ID upon entry. Please note that the prize does not include, insurance, personal expenses, additional activities beyond stipulated in the prize, or any other expenditure. The Promoter is not responsible for any expenses incurred. The winner is also responsible for the behaviour of themselves and their guests whilst enjoying the prize. The winner will be subject to the relevant hotel terms and conditions and any and all relevant rules. The Promoter reserves the right in its absolute discretion to exclude the winners and/or guests from participation in the prize if the winner and/or their guests fail to comply with the directions of the Promoter or any companies associated with the prize or the winner and/or guests act in a manner that is dangerous to themselves or to the public or is anti-social in any manner or which causes a disturbance or nuisance to others.

  8. The winner will be electronically drawn at random by an independent third-party computer process from all entries correctly submitted in accordance with these terms and conditions within 3 working days of the close date. An appropriate number of reserves will be drawn at the same time. The winner will be notified via private message on Instagram.

  9. If the winner does not respond to the notification informing them, they have won and accept their prize within 24 hours from receipt of their winning notification, they will forfeit their prize and an alternative winner will be contacted. Winners that do not fulfil the requirements set out in these terms and conditions will be disqualified. Reserve winners may be subject to shorter acceptance times dependent on the dates of the tickets on offer.

  10. Entry is limited to one per person. The Promoter reserves the right to disqualify any winner who uses multiple accounts and to require them to return any prize they may have won. The Promoter will verify the eligibility of all entrants. The Promoter will require as much information as it considers reasonably necessary for this purpose and the Prize may be withheld unless or until the Promoter is satisfied with the verification.

  11. The prize is non-transferable and there is no cash alternative. The Promoter reserves the right to substitute a prize with a prize of equal or greater value if for example, a COVID-19 outbreak leads to the hotel having to postpone the stay, then an alternative date will be offered, if it can be fulfilled within any applicable COVID-19 rules, regulations, or government guidance.

  12. Winners and their companions are each responsible for ensuring that they have all necessary vaccinations as required. Winners and their companions are responsible for ensuring that they adhere to all/any Covid-19 related protocol.

  13. The winner will be required to provide their full name, email and contact number. Hotel booking details will be sent to the winner via email. This booking will become the sole responsibility of the winner.

  14. Entry to the Gallivant Hotel is subject to the normal terms and conditions of entry. It is the responsibility of the winner and their companion to ensure that they read the applicable terms of entry the hotel.

  15. The Promoter will use your personal information only in accordance with these terms and conditions and its privacy policy which can be found at https://footer.diageohorizon.com/dfs/assets/www.diageo.com/PrivacyPolicy_en.html?locale=en-gb. The Promoter will only use your personal information for the purpose of carrying out the Promotion. Where the Promoter is not responsible for the fulfilment of or delivery of the prize, the Promoter shall share your personal information with UNIT and DIAGEO who is responsible for the fulfilment of the Prize.

  16. Entrants to the Promotion can, at any time (including at or before the time of entry), object to all or some of their personal information being made available in accordance with paragraph 15 by emailing consumercare.GBandIreland@diageo.com. However, the Promoter shall provide the information set out in paragraph 15 upon request from such competent authorities (including without limitation the Advertising Standards Authority).

  17. The Promoter reserves the right to withdraw, amend or terminate (temporarily or permanently) these terms and conditions or the Promotion with or without prior notice where it becomes necessary to do so due to any unforeseen circumstances outside its reasonable control (including, without limitation, in the case of anticipated, suspected, or actual fraud or in the event of technical or other difficulties that might compromise its integrity).

  18. No correspondence will be entered into concerning the result and the Promoter’s decision in all matters relating to the Promotion is final.

  19. The Promoter and its agents accept no responsibility for entries that are not received for any reason or difficulties experienced in submitting an entry to this Promotion and proof of submission will not be accepted as proof of delivery.

  20. The Promoter is not responsible for computer or network problems, problems with servers, other programming, electronic or technological failures/errors/malfunctions of any kind (including but not limited to filtering by or operation of the functionality of thebar.com) or the failure to receive any emails or inability to contact the potential prize winner for any reason whatsoever.

  21. While nothing in these terms and conditions will limit the Promoter’s liability for death or personal injury caused by its negligence or for fraud, the Promoter will not be legally responsible to entrants or winners for any losses that were not foreseeable to the Promoter or to the entrant at the time of entry to the Promotion or which are caused by a third party.

  22. This Promotion and these terms and conditions are governed by English law and subject to the non- exclusive jurisdiction of the English Courts.

  23. Entrants are deemed to have accepted these terms and conditions by participating in this Promotion.
