The Promoter of this competition is: DUSK, DRINKI Limited, a company registered in England and Wales under company registration number 08704401 and have the registered office at Flat 39 Lion Mills, Hackney Road, E2 7ST.

This competition is open to United Kingdom (England, Scotland, Wales and Northern Ireland) residents aged 18 or over, excluding employees and their immediate families of DUSK, (“Promoter”), its subsidiaries, other group companies, its agents, or anyone else professionally connected with this competition.

The competition will run from 8am 7th June 2022 to 5pm 13th July 2022 inclusive (“Promotional Period”). Any entries received outside the Promotional Period will not be accepted.

You can enter into the competition with a maximum of three different stories. To enter the competition, users must submit details about a friend they made in the bathroom of a bar, pub, club, via the Bathroom BFF DUSK submission form or via a tagged story to the DUSK Instagram channel. By entering the competition, both parties agree to share their social media handles with any ‘matches’ to identify likeness. All submissions will be entered into a prize draw and chosen at random. The winning pair will be announced on DUSK social media channels and will be notified by email within ten working days of the closing date.

The winner will have three working days to respond. If they cannot be contacted, DUSK reserves the right to withdraw the Prize from the winner and select replacement winners at random.

The winner will need to confirm that they are a UK resident aged 18+. Failure to do this, or if the winner is ineligible or rejects the Prize, will result in the Prize being forfeited and the Promoter may at its absolute discretion award the Prize to a reserve, selected at the same time as the original winner, or reallocate the Prize at its discretion without liability to the winner. The process will repeat until an eligible winner is able to claim the Prize. The decision of the Promoter is final and no correspondence will be entered into. Entrants are encouraged to monitor their email during this time in case they are the winner.

The Prize draw will take place five working days after the competition has closed by an independent adjudicator who will randomly select the winner from all valid entries received during the Promotional Period.

If the winners are unable to take up a Prize for any reason, or if DUSK has not been able, after making reasonable efforts, to make contact with the winner, DUSK reserves the right to award that Prize (without notice to the first winner chosen) to an alternative winner, in which case the first winners chosen shall not be eligible for any share of the Prize whatsoever.

The decision shall be final and unchallengeable and at the Promoters absolute discretion they may declare void any entry/ vote or the competition itself should they consider that there are no entries reaching a required standard, whereupon they can award Prizes or not as they think fit.

The Prize (“The Prize”) consists of the following: two WEAREFSTVL XCLSV tickets on 6th & 7th August 2022 and overnight accommodation on the 6th August 2022 at the The Stratford hotel in London including breakfast.

The prize will take place on 6th August 2022 and will include two WEAREFSTVL XCLSV tickets, including meet-and-greet with backstage tour, access to the Artist Village, drinks tokens worth £100, and a one-night stay on 6th August 2022 in the The Stratford hotel in London. Dates, destinations, and other specific details of a Prize are subject to availability.

The Prize is as stated and no cash or other alternative Prizes will be offered in whole or in part.

In the event of circumstances outside of its control, the Promoter reserves the right to substitute the Prize, or part of the Prize, with one of equal or greater value at the choosing and discretion of the Promoter.

The winner takes part in the Prize at their own risk and to the fullest extent allowed by law; the Promoter accepts no liability with regard to such Prizes whatsoever. The Promoter will have no liability in relation to the conduct of the winner, nor in connection with any circumstances outside its control with respect to the Prize once delivered to the winner.

The winner(s) and guest(s) are responsible for all expenses not expressly stated in these Terms and Conditions as being included as part of the Prize.

DUSK will not be liable for any circumstances beyond its reasonable control that prevent the competition being fulfilled, a winner or winners being chosen, or any Prize being taken up or fully enjoyed by a winner.

The winner agrees to the use of their name and image in any publicity material from DUSK. The reunion may be photographed and filmed for editorial media purposes and for use on DUSK’s social media channels and in editorial interviews.

By submitting an entry to the promotion, you understand and agree that you are providing information to the Promoter. You accept that this information will be retained for up to three months after the Prize has been issued. This information will be processed in accordance with the Promoter’s Privacy Policy which can be viewed at: https://www.dusk.app/privacy-policy/

Participants’ entries will be rendered invalid if they are deemed to contain offensive, defamatory, malicious, indecent or other inappropriate content; includes the names of any individual without their express permission; in the reasonable opinion of the Promoter, cause any widespread or serious offence (taking into account prevailing community views or standards); contains any content that could reflect negatively on the name, reputation, or goodwill of the Promoter or any brand partner; includes trademarks, logos, or copyrighted material not owned by the entrant or used without the right holder’s prior written permission, including famous names, company names etc; contains any images of children; or contains content deemed socially irresponsible or likely to breach the CAP Code.

If any element of this promotion is delayed or affected due to the continuing COVID-19 pandemic, the Promoter will endeavour to update entrants as to any unavoidable changes to the promotional dates or Prize.

The winner must be aged 18+ and the winner’s guest must be aged 18+. Proof of age may be required.

It is the responsibility of the entrant to provide correct, up-to-date details when entering the promotion and on acceptance of the Prize. The Promoter cannot be held responsible for the winner failing to supply accurate information which affects Prize acceptance or fulfilment of their Prize.

Sale, transfer or exchange of any part of the Prize package is strictly prohibited. Any attempt to sell, transfer or exchange the Prize will result in the Prize being withdrawn by the Promoter and the Prize will be declared null and void.

The Prize must be taken by the winners in person unless otherwise agreed in writing by the Promoter.

The Promoter will not be held responsible for the winner not taking advantage of the Prize due to health or any other reason.

The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense or damage which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this promotion or accepting or using the Prize, except for any liability which cannot be excluded by law (including personal injury, death and fraud) in which case that liability is limited to the value of the Prize. The Promoter reserves the right to verify all entries including but not limited to asking for proof of address and ID (passport, driving licence or equivalent) and to refuse to award the Prize or disqualify any entrant where there are reasonable grounds to believe there has been a breach of these Terms and Conditions, the spirit of the promotion or any instructions forming part of this promotion’s entry requirements or otherwise where a participant has gained unfair advantage in participating in the promotion or won using fraudulent means.

If for any reason any aspect of this promotion is not capable of running as planned, including by reason of infection by computer virus, network failure, bugs, tampering, unauthorised intervention, fraud, technical failures or any other cause beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter may in its sole discretion modify or suspend the competition or invalidate any affected entries. If an act, omission, event or circumstance occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these Terms and Conditions the Promoter will not be liable for any failure to perform or delay in performing its obligation.

If any of these clauses should be determined to be illegal, invalid or otherwise unenforceable then it shall be severed and deleted from these Terms and Conditions and the remaining clauses shall survive and remain in full force and effect. Personal data is not shared with third parties except for the above purposes, in accordance with applicable law.

The Promoter will make available the winner’s surname and country of residence upon request by emailing bff@dusk.app within 3 months after the closing date of this promotion. Promoter reserves the right to refuse any or all such requests. Entrants can object to disclosure, or request that disclosure be limited in scope by contacting bff@dusk.app. The Promoter may nevertheless disclose the information to the Advertising Standards Authority if required to do so.
